Minibaud Bulletin Boards Terms of Service

1. Acceptance of Terms

Welcome to Minibaud Bulletin Boards. By accessing or using our service (the “Service”), you agree to be bound by these Terms of Service (“TOS”). If you do not agree to all of these terms, please do not use the Service.
We may update these TOS from time to time. Continued use of the Service after changes constitutes your acceptance of the new terms. We will notify users of significant updates via the site.

2. Your Registration Obligations

You agree to provide true, accurate, current, and complete information when registering and to keep this information updated. We reserve the right to suspend or terminate your account if any information is found to be inaccurate or incomplete.

3. Age Restriction

You must be at least 18 years of age to access Adult 18+ boards and content. By using such areas, you represent and warrant that you are at least 18 years old.

4. Privacy Policy

Your privacy is important to us. We collect, use, and disclose personal information in accordance with Alberta’s Personal Information Protection Act (PIPA) and other applicable Canadian laws. Please review our Privacy Policy. We will notify affected users of any data breaches where required by law.

5. Member Account, Password and Security

You are responsible for maintaining the confidentiality of your password and account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account.

6. Member Conduct

You are solely responsible for all content you post or transmit through the Service. You agree not to post or transmit any content that is unlawful, defamatory, obscene, harassing, threatening, or that infringes on any third-party rights, including content that exploits minors.
You must comply with all applicable laws, including Alberta’s Consumer Protection Act.
We reserve the right to remove any content that violates these TOS and to terminate accounts for repeated violations.

7. Indemnity

You agree to indemnify and hold harmless Minibaud Bulletin Boards, its officers, directors, employees, and agents from any and all claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, your content, or your violation of these TOS or any third-party rights.

8. No Resale or Commercial Exploitation

You may not reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the Service without our prior written permission.

9. Direct Linking

Hotlinking to images, files, or other content on this site without explicit permission is prohibited.

10. General Practices

We may establish general practices and limits concerning use of the Service, including storage limits. We have no responsibility or liability for the deletion or failure to store any messages and other communications or other content.

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or to any third party for any such modification, suspension, or discontinuance.

12. Termination

We may terminate or suspend your account and access to the Service at our sole discretion, with or without cause, and with or without notice. Upon termination, we may delete your account and all related content without liability.

13. Proprietary Rights

The Service and all content, features, and functionality are owned by Minibaud Bulletin Boards or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any part of the Service.

14. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We make no warranty that the Service will be uninterrupted, timely, secure, or error-free, or that any content will be accurate or reliable.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY ALBERTA AND CANADIAN LAW, IN NO EVENT SHALL MINIBAUD BULLETIN BOARDS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES.
Our total liability to you for any damages shall not exceed CAD $100 or the amount you paid us in the past 12 months, whichever is greater (if any). These limitations apply even if a remedy fails its essential purpose.

16. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of laws principles. You irrevocably submit to the exclusive jurisdiction of the courts of the Province of Alberta for any dispute arising out of or relating to these TOS or the Service.

17. Consumer Protection

We fully comply with Alberta’s Consumer Protection Act and the Alberta Consumer Bill of Rights. If any provision of these TOS is found to be unfair or unenforceable, it shall be severed, and the remaining provisions shall remain in full force and effect. We do not engage in unfair business practices.

18. Miscellaneous

These TOS constitute the entire agreement between you and Minibaud Bulletin Boards. If any provision is held invalid or unenforceable, the remainder of the TOS shall continue in full force. No waiver of any term shall be deemed a further or continuing waiver.
